Medicaid Planning
Nursing home care is expensive. Although long-term care insurance will pay for some or all of the monthly bill, many people do not own this type of insurance coverage. For those without insurance, paying for the cost of care can quickly drain a person's life savings, and leave a husband or wife still living at home with barely enough to survive. In such situations, many people look to financial assistance from the Medicaid program.
Medicaid is a state/federal program which will pay the cost of nursing home care for people who cannot pay for it themselves, provided they apply and qualify for assistance under the Medicaid program.
In order to qualify for assistance, a person must meet very strict eligibility standards. We are familiar with the Medicaid program and regularly counsel clients concerning how they should arrange their affairs in order to qualify for assistance at the earliest possible date.
It should be noted that the rules for operation of the Medicaid program in Rhode Island may soon change. The State of Rhode Island recently obtained a Global Medicaid Waiver from the federal government. Under the waiver Rhode Island has the right to develop new rules for operation of the Medicaid program within the state. The new rules may introduce sweeping and controversial changes. In this regard the General Assembly may seek to exercise extraordinary oversight in order to protect the estimated 1 in 7 Rhode Island residents who are touched by the Medicaid program.
Trustee Training
Many of our clients establish a revocable living trust as the centerpiece of a Foundation Estate Plan. At the outset they serve as trustees of their trusts, and they frequently name a responsible child or other family member to step in as successor trustee when they are no longer able to act on their own.
When that time comes, a successor trustee may not have a clear understanding of a trustee's authority on the one hand, and a trustee's fiduciary duties and obligations on the other.
We conduct Trustee Training for successor trustees so that they will understand their authority and responsibilities.

Caring for an aging parent or relative is one of life's most challenging tasks. The task is difficult if the elderly parent or relative lives nearby, but it is even more challenging when he or she lives in a distant city.
Our Senior Assistance Service is designed to take the confusion and frustration out of a loved one's life as his or her abilities begin to slip. In addition to a complete legal review of existing planning, we do what he or she cannot do, whether the task be paying bills, preparing tax returns or helping with worries as yet unnamed, all in a caring but professional manner.
